General Terms and Conditions of Alpin Family GmbH and its subsidiaries
The present identical GTC apply to contractual partners.
1. General Information
The following general terms and conditions (GTC) apply. These represent the contractual content for which Alpin Rentals GmbH and its subsidiaries conclude an accommodation contract with their guests. Alpin Family GmbH and its subsidiaries manage and provide accommodation in 5710 Kaprun, 5700 Zell am See, 5753 Saalbach-Hinterglemm, 5771 Leogang, 5542 Flachau and 6543 Nauders in accordance with the current offer for the accommodation of guests. The accommodation is rented to the guest for the agreed contractual period exclusively for use for holiday and accommodation purposes and may only be occupied by the maximum number of persons stated in the booking. The conclusion of the contract takes place in the full exception area of the Tenancy Act (MRG).
2. Services and pricing
The services of Alpin Family GmbH and its subsidiaries are based on their service descriptions and price calculations. The contractually agreed services and prices follow from the information referring to them in the reservation confirmation. Unless stated separately in the reservation confirmation, the prices listed include the costs of normal energy consumption.
The rental price does not include additional services requested by the guest (e.g. additional cleaning, additional bed linen, etc.). By making a booking, the guest offers Alpin Family GmbH and its subsidiaries as accommodation provider the binding conclusion of a contract for the object selected by the guest. In the case of electronic bookings, Alpin Family GmbH and its subsidiaries shall confirm receipt of the booking electronically. The booking shall be made for all participants named therein. As a contractual partner of Alpin Family GmbH and its subsidiaries, the guest shall be liable for their contractual obligation as for his or her own obligation.
The information provided electronically (service descriptions, price calculations...) is binding for Alpin Family GmbH and its subsidiaries, although Alpin Family GmbH and its subsidiaries expressly reserve the right to make changes to this information. The guest will be informed of such changes at the latest upon arrival. If the declaration of acceptance by Alpin Family GmbH and its subsidiaries differs from the content of the guest's booking, this shall be deemed a new offer. Any picture material of the accommodation objects provided does not necessarily represent exactly the same accommodation object rented by the guest.
3. Payment and deposit
The guest is obliged to pay an immediate deposit of 100% of the total rental fee (Flexible and Non Refundable Rate) upon receipt thereof before the start of the stay. If no special agreement has been made, the entire accommodation charge, including charges for ancillary costs and additional services, shall be due for payment at the start of the stay and payable to Alpin Family GmbH and its subsidiaries. If the guest does not make the deposit or final payment within the agreed deadlines or when the amount is due and Alpin Family GmbH and its subsidiaries are ready and able to provide the contractual service, the latter may withdraw from the contract after issuing a reminder with a deadline and assert claims for damages against the guest.
The guest is obliged to provide Alpin Family GmbH and its subsidiaries with a security deposit for keys, furnishings and equipment provided, depending on the equipment category, but in any case at least € 300.00. The security deposit shall be paid in any case before the start of the stay and is not interest-bearing. It will be returned to the guest without delay after the end of the stay, at the latest within 30 days (depending on the credit card company) after departure, and proper return of the accommodation upon departure. In case of
payment by credit card, the amount will be debited immediately.
4. Duration of stay
On the day of arrival, Alpin Family GmbH and its subsidiaries shall make the accommodation available to the guest between 4.00 p.m. and 6.00 p.m. in a condition in accordance with the contract. On the day of departure, the guest shall vacate the accommodation and hand it over to Alpin Family GmbH and its subsidiaries between 08.00 and 10.00 hrs. The guest shall return the accommodation broom-clean, dispose of any waste and strip the beds. The guest is obliged to fill in a check-in form on arrival and a check-out form on departure, in which the detailed circumstances and conditions of the stay and the equipment of the accommodation are noted. Complaints regarding the accommodation must be made by the guest immediately upon taking possession of the same, otherwise it shall be assumed that the accommodation including inventory was in the agreed and contractual condition.
5. Cancellation or no-show
In the event of withdrawal, the claim of Alpin Family GmbH and its subsidiaries to payment of the agreed price of the stay, including charges for additional services, shall in principle remain in force in accordance with the following provisions:
The guest shall pay the following amounts, in each case based on the total price of the accommodation services (including all additional charges), but excluding any public charges such as tourist tax: Cancellation and withdrawal up to 14 days before arrival date:
0% of the costs Cancellation and withdrawal from 13-0 days before arrival day:
100% of the costs
later cancellation and withdrawal or non-arrival or in case of failure to notify
100% of the costs except when booking the Non Refundable Rate 100% must be paid immediately.
This amount is no longer refundable!
Alpin Family GmbH and its subsidiaries are entitled to debit these amounts from the guest's credit card in the event of payment by credit card.
(The deadline is understood to be from the date of receipt of the cancellation or withdrawal declaration by Alpin Family GmbH and its subsidiaries, must be in writing and is binding. Until the start of the stay, the guest may request that a third party take over the rights and obligations arising from his or her rental contract (substitute tenant). Alpin Family GmbH and its subsidiaries are entitled to object to the entry of the third party if his participation conflicts with special tenant requirements, legal regulations or official orders. If a third party enters into the contract, the guest and the third party shall be jointly and severally liable for the rental price and any additional costs incurred due to the entry of the third party. In the event of cancellation and withdrawal by the guest, Alpin Family GmbH and its subsidiaries shall endeavour to find another use for the accommodation within the scope of their ordinary business operations without any obligation to make special efforts and taking into account the special character of an accommodation.
Alpin Family GmbH and its subsidiaries shall take into account alternative occupancy and, insofar as this is not possible, saved expenses. Notwithstanding this, it shall be entitled to alternatively withdraw from the contract and assert claims for damages instead of the claim to the rental price. In the event that Alpin Family GmbH and its subsidiaries withdraw from the contract before the start of the stay for reasons of unforeseeable force majeure, the guest shall have the right to choose to withdraw from the contract free of charge and with reimbursement of payments already made or to demand the provision of an equivalent rental property if Alpin Family GmbH and its subsidiaries are in a position to offer such a property from their range at no extra cost.
6. Liability/ Limitation
The contractual liability of Alpin Family GmbH and its subsidiaries as well as its vicarious agents is generally limited to gross negligence and intent, for all damages other than personal injury. Alpin Family GmbH and its subsidiaries shall in particular not be liable in cases of force majeure (e.g. fire, power failure, internet failure, circumstances beyond the control of Alpin Family, etc.) Liability for the conduct of third parties is excluded.
The liability of Alpin Family GmbH and its subsidiaries in tort is limited to the rental price for property damage that is not due to intent or gross negligence. This maximum liability amount applies per rented object.
7. Duties of the guest
The guest undertakes to treat the accommodation together with the inventory with all due care. The guest is liable to pay compensation for damage to furnishings, accommodation rooms or the building, as well as to the installations and movable property belonging to the accommodation rooms or the building, even if this damage was caused by his companions or visitors. Damage occurring in the accommodation rooms must be reported immediately by the guest to Alpin Family GmbH and its subsidiaries or to a contact point named by them, insofar as the guest is not obliged to remedy the damage himself. The guest shall in any case be liable to pay compensation for any consequential damage caused by failure to report defects in good time. If the notification of defects is culpably omitted, the guest's claims shall also be forfeited in whole or in part. The guest may only terminate the contract in the event of significant defects or disruptions or may justifiably withdraw from the contract prior to commencement. The guest shall pay for the consumed rental time on a pro rata basis.
The guest must first set Alpin Family GmbH and its subsidiaries a reasonable deadline for remedial action within the framework of the notification of defects, unless remedial action is impossible, is refused by Alpin Family GmbH and its subsidiaries or immediate termination is objectively justified by a special interest of the guest recognisable to Alpin Family GmbH and its subsidiaries, or continuation of the stay is unreasonable for such reasons.
It is not permitted to bring or accommodate pets in the accommodation. Violations of this entitle Alpin Family GmbH and its subsidiaries to extraordinary termination of the guest accommodation contract. Alpin Family GmbH and its subsidiaries may immediately terminate the rental contract if the guest, notwithstanding a warning from Alpin Family GmbH and its subsidiaries, persistently disturbs the operation of Alpin Family GmbH and its subsidiaries or the performance of the stay - including that of other guests - or if the guest behaves in a manner contrary to the contract to such an extent that the immediate termination of the contract appears justified. If Alpin Family GmbH and its subsidiaries justifiably dissolve the contract for these reasons, the guest's full payment obligation shall remain in force, including any obligations to pay damages on the part of the guest.
8.Check In (Arrival) and Check Out (Departure) outside of the business hours
Check in: Check in is charged as follows:
20:00 to 22:00: € 50,00 excl. VAT | 22:00 to 0:00: € 100,00 excl. VAT.Check In is not possible after 0:00. For accommodations where keylock is available, check in after 20:00 and before 08:00 will be charged € 25,00 excl. VAT for keylock preparation.
The accommodation must be vacated by 10.00 a.m. on the day of departure in proper condition, in accordance with point 4. In the event of late vacating of the accommodation, i.e. after 10.00 a.m., Alpin Family GmbH and its subsidiaries are entitled to charge the costs of an additional half day according to the offer, but at least € 50.00. From a departure after 4.00 p.m., 100% of the daily price will be charged. These contractual conditions entitle Alpin Family GmbH and its subsidiaries to retain the deposit paid to the extent of the actual damage or to the extent of the retention rights and claims in accordance with the conditions in the event of improper departure, in the event of damage left behind.
If the check-out was carried out on the day before departure and this takes place before 8.00 a.m. of the next day, Alpin Family GmbH and its subsidiaries reserve the right to retain the paid deposit until the accommodation has been inspected by the staff of the hotel. Alpin Family GmbH and its subsidiaries reserve the right to retain the deposit paid/paid until the accommodation has been inspected by the staff of Alpin Family GmbH and its subsidiaries. The deposit paid/paid will be refunded retrospectively after the inspection. The provisions of point 4 remain unaffected by this.
9. Severability clause
Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the rest of the contract shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision the effects of which come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply accordingly in the event that the contract proves to be incomplete. Alpin Family GmbH and its subsidiaries reserve the right to amend these terms and conditions at any time without prior notice.
10. Applicable law / place of jurisdiction
It is agreed that only Austrian law shall apply, expressly excluding the UN Convention on Contracts for the International Sale of Goods. For all disputes arising from this contractual relationship, the competent court for Kaprun shall have exclusive jurisdiction. The place of performance shall in any case be Kaprun as the place of accommodation. The contracting parties confirm that the contractual and negotiating language is German and that they have taken note of the content of these GTC.
11. Electronic passport copies
With reference to the Austrian Registration Act and to establish your identity, we take an electronic copy of your passport at check-in. This electronic copy is not passed on to third parties and is deleted six months after departure.
The data you provide is required for the official guest registration and will be forwarded to the municipality. Furthermore, subject to your consent, the data may be used to identify you within the Joker Card / Flachauer Card / Zell am See Kaprun Sommercard or the Saalfelden Leogang Card system. (depending on the region in which your accommodation is located and which card you have included in your booking). The data can be viewed by the tourism association, the mountain railways and the system operator CapCorn or Feratel. By using the guest card, access to the facilities of the service partners is recorded and stored for a limited period of time. This data may not be passed on to third parties. As the main traveller or tour guide, you declare that you will inform any fellow travellers named by you of this and obtain their consent in the same way.
